Tuesday, December 24th, 2002 continued...  

10:56-11:18am

From when Scott logged off the computer to when he left the warehouse would be about a 22 minute window. During this 22 minutes, Scott would also need to open the roll up door to the warehouse, back his truck up, hook up the boat, pull the boat out, close the rollup door to the warehouse from the inside and exit back out the pedestrian door through the office.

Scott said:
He estimated he was at the warehouse about an hour

Scott arrived at the warehouse around 10:17 and left around 11:18
(see next entry). He was one minute off.

Scott said:
He thought it took him an hour and a half to drive to the Berkeley Marina, maybe a little longer because he was pulling a trailer.

11:18-12:54pm

Featured Facts:
Per Yahoo maps, it is one hour and 36 minutes to the Berkeley Marina. We know he was at the marina at 12:54 (see next entry), so working backwards, he left the warehouse around 11:18. (1027 N Emerald, Modesto to 201 University, Berkeley)


Scott said:
Scott said he purchased a ticket in parking lot at the Berkeley Marina. Scott gave this receipt to the police the evening of Dec. 24th when they asked him if he had any proof he'd been at the marina.

12:54pm

The ticket Scott purchased at the Berkeley Marina was time stamped at 12:54pm.

The police didn't believe Scott when he told them he was at the marina even though he'd given them a receipt. They solicited information from the public on January 2nd stating, "Police are trying to corroborate Scott's trip to the Berkeley Marina." This news release cast further suspicion on Scott in the public eye.

Scott said:
Scott said he motored north for probably 2 miles. He said he was near a little island and that the island had a bunch of trash on it, a big sign that said "No Landing", and there were some broken piers. He assumed it would be a decent shallow area. He had forgotten his new lures from Big 5 in his truck, so he used some fresh water jigs from his tackle box. He trolled a bit and then headed back because it was getting wet. He said he talked to a couple other fishermen and he also was seen by some maintenance workers who were laughing with him when he backed his trailer into a post while trying to load the boat. Scott estimated he was at the marina about 90 minutes.


Featured Fact:
Fitting Scott's description, the island described turned out to be Brooks Island. The photos below show the trash, the piers he described as well as the "No Landing" sign. Featured Fact:
Confirming Scott's estimate, three prosecution witnesses gave estimates of the distance from Berkeley Marina to Brooks Island. Christopher Boyer estimated less than 2 miles, Dodge Hendee estimated 2.5 miles, and Geoffrey Baehr estimated a little bit more that two nautical miles. (See their testimonies)


Featured Fact:
Scott's Big 5 bag containing his new lures was found by the police in his truck the evening of December 24th, confirming his statement that he had left them there. The fishing pole Scott purchased on December 20th was found with a fresh water jig attached. This would indicate that he assembled his new fishing pole while out on the water, when his new lures where not on hand.

12:54-2:12pm

Featured Fact:
From the time Scott bought the ticket to when his cell phone records show him leaving the area is about 1 hour and 18 minutes. Scott had estimated 90 minutes, he was 12 minutes off.


Scott said:
When he left the marina Scott said he called Laci at home and on her cell phone. He also said he called Greg Reed and his parents on the way home. He got stuck in some traffic. Pulled over for gas at a Chevron in Livermore and called Laci again.

2:12-3:25pm

Featured Facts:
Scott's cell phone records and debit card records confirm all of the calls Scott claimed he made on his way home from the marina. At 2:12 pm Scott checks his voicemail, calls home and calls Laci's cell phone. The following message from Scott was listened to by detective Brocchini on Laci's voicemail the evening of December 24th, "Hey, Beautiful. I just left you a message at home. It's 2:15. I'm leaving Berkeley. I won't be able to get to Vella Farms to get the basket for Papa. I was hoping you would get this message and go on out there. I'll see you in a bit, sweetie. Love you. Bye."
At 2:34pm records show a 5 minute 1 second call to Greg Reed. According to testimony they confirmed plans for New Years Eve. (See Greg Reed testimony) At 2:40pm there is a 3 minute 9 second call to Lee, and at 2:24pm there is a 2 minute 27 second call to Lee.

3:25-4:26pm

Featured Fact:
Scott's Chevron purchase was at 3:25pm. It is a one hour and one minute drive from the Chevron to his warehouse per Yahoo Maps, (1025 N Vasco Rd, Livermore to 1027 N Emerald, Modesto) placing him back at the warehouse around 4:26pm. Scott makes another call to Laci's cell phone at 3:52pm but does not leave a message.


Scott said:
He arrived back at the warehouse and unhooked the boat. He estimated spending no more than five minutes in the office. He thinks this is when he sees a fax regarding an incoming shipment. He tells the police he remembers seeing the fax because he was disappointed that the shipment was arriving when it was.


Featured Fact:
The incoming fax to Scott's office was introduced as Defense T during the trial. It was time stamped at 14:28 EST which would be 11:28 PST. Due to the sheer volume of exhibits in this case, this is one of the many that did not get posted.

4:30-4:45pm

Scott said:
Scott estimated he arrives at home between 4:30 and 4:45. He entered through the side gate where he finds their dog, McKenzie, with his leash on. Scott removes the leash and puts it on the patio table.


Featured Fact:
It is discovered later that night that the next door neighbor, Karen Servas, had found McKenzie in the neighborhood with his leash on and put him back in Scott and Laci's yard. (See Karen Servas testimony)


Scott said:
He entered the home and the dog and cat ran into the house. Scott emptied the mop bucket because it looked like the cat might drink out of it.He poured the water out near the front walkway and placed the bucket and mops there. He got the mail while outside.

Photos taken by the police on the evening of December 24th show the bucket and two mops outside the family room door near the front walkway.

Scott said:
He assumed Laci was at her mom's preparing for dinner. His clothes were a bit wet so he undressed and put them into the washer and dryer. He first removed the dirty cleaning rags from the washer that the maid had left from the day before. He added soap and started the washer. He said he often did this when he got home because he works with chemicals.


Featured Facts:
Scott and Laci's home had no garage. The washer and dryer were located in the family room which used to be the garage. Having no garage, there would be no where for Scott to leave clothes that were wet or stained with chemicals, so he would put them straight into the washer. Having no garage also helps explain why Scott would take the patio umbrellas to the warehouse to store them.

The picture below on the left shows the converted family room with the washer and dryer to the left. The door to the right of the washer and dryer is the door that Scott used to place the mops and bucket outside. The picture below to the right shows the rags on top of the washer December 24th.

Scott said:
He took the pizza box out of the refrigerator. He pours a glass of milk and heads to the shower with pizza in hand.


Featured Facts:
Officers Letsinger and Evers testified to the pizza box being on the counter when they arrived at the home Christmas Eve night.

Scott said:
He showered and got dressed. He went back into the kitchen and listened to the phone messages. He heard the message he left Laci when leaving the marina. Then he heard a message left by Ron (Laci's mother's companion) asking Scott and Laci to bring whipped cream with them when they come. This prompts Scott to call their home, since he was assuming Laci was already there. Scott asks if Laci is there. She is not. Scott tells Sharon that Laci's car is in the driveway, but she's not home. Sharon asks if McKenzie is in the yard and that is when Scott remembers that the leash was on the dog. Sharon tells Scott to check the park. And then begins the search for Laci.

Ron Granski testified that he did leave the message for Scott and Laci to bring over whipped cream.

5:17pm

Sharon Rocha (Laci's mom) testified that Scott called at 5:17 to see if Laci was there.
