Reply Brief

This is the third of three documents that needed to be filed with the Supreme Court of the State of California for Scott’s appeal. The next step is oral arguments. Scott’s appellate attorney, Cliff Gardner, and an opposing attorney from the State Attorney General’s office will be called before the Supreme Court of the State of California for an hour or two of oral arguments. This day will most likely occur in two to three years. Once the Court hears oral arguments, they will hand down a decision on Scott’s appeal within 90 days.

The filing of this third document also starts a six month countdown for Scott’s habeas petition. This is a separate court filing where Scott’s attorneys bring forth new evidence and information that was not heard in court. The deadline for the habeas petition to be filed is January 23, 2016.

The courts could overturn Scott’s conviction based on the information in either one of these filings.

While we all have different views on this case, I do believe its obvious that this is a site geared towards those with views pertaining to Scott's innocence. So it is immature and thoughtless to come and post replies such as this. There are entire sites dedicated to people who share your feelings. Please spare the family and express them there. Questions -
1. How does someone predict that their pregnant wife will be "lost" prior to them disappearing?
2. How do their bodies float to the surface in the same area that Scott was fishing?
3. Who doesn't stay home to help their pregnant, tired wife with preparing Christmas Brunch? if he really loves her?

The truth can be found in the factual evidence provided at trial. The other "Laci" sightings were of another 8 month pregnant woman with a Labrador Retriever who resembled Laci. There is a excellent book, " A Deadly Game" by Catherine Crier that provides the factual evidence offered in Court.

It costs the taxpayers more money $ to put him to death than it would a life sentence. Scott is Guilty and deserves the punishment determined by the jury.

First off, do not simply assume that everyone who believes that Scott Peterson might be innocent are "religious fanatics", as I am 38 and have not been religious in any way a day in my life. I am anti-death penalty, to be fair, but that has nothing at all to do with why I believe that there is a high probability that Scott had nothing to do with his wife's disappearance/murder. A TOTAL LACK OF ANY PHYSICAL EVIDENCE THAT SCOTT HAD ANYTHING TO DO WITH IT, COMBINED WITH VERY LITTLE CIRCUMSTANTIAL EVIDENCE THAT HE HAD ANYTHING TO DO WITH EITHER, THESE ARE THE REASONS WHY I BELIEVE THAT HE SHOULD HAVE NEVER BEEN CONVICTED OF 1ST DEGREE MURDER...I truly believe that if the local and national media hadn't done what they did, acted the way that they did, and if the media and the police/DA had not used and exploited Amber Frey and Scott's affair with her during his wife's pregnancy, that he would have never been convicted by the jury at all...However, another huge factor in his jury conviction was their pre-conceived notions about Scott and his behavior while Laci was pregnant...As one female juror who was an alternate and who was called to the jury late in deliberations put it as she first walked into the jury deliberation room, "HE KILLED THE LITTLE MAN, LET'S FIND HIM GUILTY AND GET THIS OVER WITH"...Really?

The bottom-line to this entire case is that we as a country are far too anxious and willing to convict a person and put them in prison for the rest of their life or execute them without ANY physical and/or circumstantial evidence that they did it or had anything to do with it. And the fact that Scott was a slime-ball of a husband who had an affair with another woman while his wife was pregnant with his child IS NOT EVIDENCE OF HIS GUILT IN LACI'S DISAPPEARANCE OR MURDER! It's just not evidence. NOR ARE OUR OWN PERCEPTIONS OF THE DEFENDANT'S FACIAL EXPRESSIONS OR OUR OWN PERCEPTIONS OF HIS "LACK OF EMOTION" EVIDENCE OF HIS GUILT! It's just not evidence! You don't have to like Scott Peterson or any other lying, cheating defendant who is on trial, he wasn't a good person, no doubt about that. He was a selfish man/husband who made selfish choices and didn't give a damn about his marriage...okay, that makes Scott Peterson and thousands of other married people...A murderer does that not make!

11 different people saw Laci walking her dog the morning of 12/24 around her neighborhood, long after Scott was proven to have left his house and be far away from his home, as verified by cell phone tower pings, his work computer history, his boat launch receipt and the multiple people who saw him trolling out of the Berkeley Marina in his EMPTY boat, and his cell phone pings on his way home later that afternoon. The Modesto PD ignored all 11 of these witnesses who saw and positively identified Laci walking her dog that morning, they ignored the evidence of the house directly across the street being broken into that morning, even trying to change the date of the break-in to 2 days later when it was actually early on the morning of 12/24, and they ignored multiple witnesses to the men standing outside of the house across the street next to a white van. They ignored ALL EVIDENCE OF SCOTT'S INNOCENCE, and as soon as they knew that Amber Frey existed they determined that Scott must have been guilty, case closed. THIS IS NOT HOW OUR JUSTICE SYSTEM IS SUPPOSED TO WORK PEOPLE.

****I could just as easily say that it's you people who was to see Scott suffer and die without there being one shred of physical evidence and very little to no circumstantial evidence that he had anything at all to do with Laci's disappearance who are the "Religious Fanatics" who believe in "An eye for an eye", or who are perfectly happy and feel fine about sentencing a person to death on your "gut feelings" and because Scott was a cheating husband who lied to everyone about having an affair.

HOW CAN ANYONE BE OKAY PUTTING ANOTHER HUMAN BEING TO DEATH OR TAKING THE REST OF THEIR LIFE AWAY FROM THEM WHEN THERE'S ZERO PHYSICAL EVIDENCE THAT HE HAD ANYTHING TO DO WITH IT, AND TONS OF PHYSICAL EVIDENCE THAT HE DIDN'T HAVE A THING TO DO WITH IT AT ALL? Because he's a cheating, lying, slime-ball husband he should be convicted of a murder that someone else got away with, and then executed? THIS IS WHY WE IN THE UNITED STATES NEED TO HAVE PROFESSIONAL JURORS WHO UNDERSTAND THE DEFINITION OF "REASONABLE DOUBT', BECAUSE IF THERE WASN'T REASONABLE DOUBT IN THIS CASE THEN I DON'T KNOW WHAT CASE WOULD HAVE ANY AT ALL...And jurors who don't listen to mainstream-media prosecutors who assume everyone is guilty until proven innocent, such as Nancy Grace, who would execute or lock every person even arrested for murder away for life immediately, without a trial...

Wendy I agree with you! The pain his wife and child suffered was horrific- the loss of what could have been for Lacy’s parents becoming grandparents.
Amber under oath proved Scott was guilty! How naive some of these people are to think anyone but Scott has motive is beyond my comprehension- dumbfounded!

I, too, have followed this case from the beginning and I, like Elle follow as much as I can. I live in CA. I think of Scott often. My prayers and heart go out to him and the family. I can't wrap my head around what has happened and how injustice has overtaken public opinion. It's scary scary stuff at best. People can't seem to realize that "it could happen to you too." Love to you all.

I remember this case like it was yesterday. Scott was doomed from the very beginning. He was presumed guilty, not innocent. I find it disgusting what the media did to this poor man. I can't believe how unfairly things unfolded. Not only did his lose his wife and baby, but his freedom and life was taken. I pray for Scott and his family everyday. I hope that he can get a impartial, fair trial.

I will pray for all of you. I guess he should've had a better defense going into the trial. If you're stating all the snow what's wrong with his attorney should he be called out on a poor job? I'm sorry innocent people who are given the death penalty do not react the way Scott did. He may have been nervous about them pointing this case in his direction however he said nothing to Amber about any of this. if that was my spouse and we were about to have a child and she was missing I would be honest because that's what counts in this case his honesty. Tell her the truth because his name is about to be blown all over the media. He might be embarrassed telling her but what's more important here the truth or carrying on an affair with a woman who's about to everything from the news. I'm sorry I've gotten everything you have to offer and I'm sorry I just don't buy it in at the prosecution said that at the end of the case or the end of the trial that needs to be fired and the dra i'm sorry I've gone everything you have to offer. Reading with the prosecution said, the jury should've come back with a different verdict done it could've even been a mistrial at least. The reason that Scott traveled to San Francisco Bay on Christmas Eve to "fish" was because, knowing the Modesto farm area as you say "like the back of his hand", he knew that the bodies would eventually be discovered if he buried Laci on land.

I'm sorry that you people can't accept the truth about what happened. Your hearts are broken - I understand. My mother was murdered by her husband when she was 21. None of our hearts ever healed from it. But Scott is 100% guilty. That is a FACT.

Lisa Diaz, I am very sorry for your loss. What a terrible tragedy. I too am a domestic violence survivor. I know first hand what that pain feels like. I understand your hurt. But you must understand that we will never really know if Scott did it or not, because the police did not provide enough physical evidence to convict him. Just because he cheated and lied does not make him a murderer. You need a weapon, DNA or some kind of physical evidence to put make someone the perpetrator. Everything that was provided was only circumstantial. You may not like the guy and think he is has horrible character or even a sociopath. It doesn't matter, because in america everyone has a right to a fair and un-prejudice trial. You can not condemn someone to die without the proper evidence. The State and police did not provide this in a court of law. And If they can not provide it, then it becomes an unsolved case. Period. I know that thought is truly sad, but it has to be fair. There can not be any reasonable doubt and this case had too much reasonable doubt and prejudice to convict Scott of the crime. Without these safe guards we all should be very scared if God forbid we are ever accused of something. We all have a right to due process for a reason. It's not to protect criminals, it is to protect innocent people. It is even for people that you don't care for their character. They may be horrible character but it doesn't make them a murderer. As citizens whom may be asked to sit on a jury someday, we have a responsibility to not let our emotions ruin another persons right to justice. It is "innocent until prove guilty". They did not prove he was guilty. They just didn't like the guy and said he did it. There has to be physical evidence to support it. Yes, he was at the marina, but there are no witnesses to him dumping a body, DNA on the body or in his boat or house, any murder weapon. Nothing. I hope that Scott gets his appeal, and yes, he does deserve it. I hope that the police do a better job collecting evidence and this terrible crime finally gets properly solved. I want justice for Laci and Connor so very much, but I also do not feel comfortable in my heart knowing that someone is getting ready to be put to death for this crime and it was without the physical evidence to do so. That itself would be a crime. We don't put a liar and a cheat to death in this country, and that is truly the only evidence that has been shown against Scott. Good luck to all of the families. I hope you all get the justice you deserve.

I only wish they would bump up his death date as he's living the good life on death row! No remote, no ability to feel consequences for his actions, manipulative, liar, cheater--text book sociopath. Folowed that case from beginning to end, he's as guilty as Ted Bundy was and same personality. I have been following this case from the beginning and all evidence against Scott were irrelevant and circumstantial ,I think they needed so badly to make arrest that they deliver Scott on the plate and had not examined other important evidence .American justice had many loop holes and I'm glad I moved to Europe as this case it's been great failure of American constitutional rights ,just as well as Ramsey case .I hope Scott will be freed,but no money or apologises can ever recompasate for what he had gone through and real killers are still on the lose

I have felt Scott was guilty, but something that was always in the back of my mind is how could he put Laci in the boat, motor out, dump her, without the small boat capsizing. His actions didn't help him either.

A troublesome case, conviction mostly on circumstantial evidence. But still.....what is the alternate narrative? Some bum who killed her in Modesto would not have had a boat and a truck to transport the bodies all the way to San Francisco Bay! I believe this is why the jury convicted. There would have to be reasonable doubt, and what would that doubt be founded on? So sorry for his parents and family.

I have spent many days and hours researching the court minutes, videos, blogs, movies, ect..
I FIRMLY believe in Scott... I believe he is Innocent! My heart hurts for him and his family as well as Lacis family. I'm so saddened by everyones tragic loss of this beautiful woman Laci and Connor. I keep Scott and all families in my prayers. I also pray for the day they set Scott free and realize the real monster that did this!!!

I don't know how anyone in their right mind can think this guy is guilty or ever was . Because he didn't show a lot of emotion ? That does not make someone a killer . Because he didn't want to be seen on the television during the disappearance? Helloooo, we are taking about a man who's wife goes missing and from day one is being looked at , and he's having an affair . You think someone like that wants their face exposed on tv so people like amber frey can come forward and make him look even guiltier, which ding ding ding is exactly what happened . Not to mention all the countless people that saw laci that morning while Scott wasn't even around - society and media are such a joke and people I'm sorry are extremely jumpy when one thing gets said . Not one piece of evidence did they find linking Scott to a murder and they never will - cuz anyone who is smart can see he is innocent . People like Nancy grace only act the way she does because of her own life experience and what happened to her own husband - just makes me sick how disgusting people are . And the fact they find her body not far from where he was fishing - right away the whole world knew he went fishing , u think the real killer didn't purposely put that body in the bay knowing it would wash up and that even more that would make Scott look guilty ? Laci and Scott clearly did not have huge marital problems , sure the guy was a cheater , big whoop - he was a cheating asshole husband so are 75 percent of Americans .. most u just don't hear about , but the thought that he could take this woman , this beautiful women and her baby , his baby and just end their life because the media wants u to believe the motive was to be free and run off with amber frey is absolutely ridiculous and just insane . I believe Scott to be innocent of murder. Yes a liar & cheater but there is no evidence that he murdered his family. The timeline shows that. Other leads should have been given some effort.
No one mentions the storm that hits the bay where she was found which could have brought the bodies from anywhere. Also, the police did a huge search of the bay where he fished & found nothing! They did not even find the concrete blocks that supposedly held down her body which would still have been there to be found if they existed! I believe someone snatched her from the park & murdered her. So scary that the real killers completely getting away with such a sick crime. & so many lives have been torn apart.
Look at the facts. That is what our court system is supposed to do.
I believe a new trial, so many years later like it is now, will find him innocent because there are now plenty of people in California of juror age that have never heard of this case & can provide fair judgement. Damn the media.

Rest in peace Connor & Laci.
Hold onto hope Scott & Family.

I have serious doubts that Peterson is guilty, but whether he is or isn't, in this country you don't convict someone and give them the death penalty without a shred of evidence. He was having an affair while he was married to the victim. You are going to tell me that's enough to prove guilt beyond reasonable doubt? Only in North Korea, my friend, not in America. We have standards here. The media shouldn't dictate who's guilty and who's not, who lives and who dies. That sets a very dangerous precedent. This entire case was a sham, there wasn't enough probable cause to even arrest Peterson. What is becoming of our justice system? No wonder so many death row inmates have been exonerated through DNA. The system is flawed.

Just been watching the most recent documentary, I lived in Georgia at the time of the disappearance and trial and truly believed he was innocent and still do more than ever there is no question he acted foolishly after they went missing and by having the affair but by no means makes him a murderer!! He was guilty before the trial and in this respect he could never get a fair trial, bring on the appeal! All the best from scotland x

All of these years I have believed he is guilty. I was hearsick for Laci's family but only kinda felt sorry for Scott's. Iam ashamed of that now. I do not know what to feel today after reading all of this. The timeline and things that are proven to be fact as he stated make me wonder. His affair with Amber Frye is not mentioned but I feel that was a defining moment for the jury. As much as I destest cheaters, this doesn't make a murderer. Maybe for anyone on the fence at that point he became the monster to hate. I just really felt her testimony was a driving force. I am now on the fence with this. I just don't know.

Don’t be in the fence- he did it! What man pretends to be single with a 9 month pregnant wife especially conner was a son men boast about having a son
The married men usually screw around when their kids are older and the marriage is dull
They were just beginning - he simply didn’t want to be a Dad

I just finished watching A&E's "The Murder of Laci Peterson" series. After seeing evidence that was ignored and/or excluded by the police, and misrepresented (or outright wrong) in the prosecution's case, I believe Scott is innocent. God Bless the efforts of the SPA group in continuing the fight for Scott.

After reading all the comments Trish said it best- I would 💯 % agree and that is why he is in fact GUILTY needs to be sentenced ASAP to hell not heaven where his wife and son are.
